1. Acceptance of Terms

By accessing or using MetaPhotoAI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

MetaPhotoAI is operated by MetaPhotoAI ("Company", "we", "us", or "our"). These Terms govern your use of our web application available at metaphotoai.app and any related services provided by us.

2. Description of Service

MetaPhotoAI is an AI-powered metadata generation service for stock photographers. Our Service allows users to:

• Upload images for metadata generation
• Generate titles, descriptions, and keywords using AI technology (English language only)
• Automatically categorize images for various stock photo agencies
• Embed IPTC/EXIF metadata directly into image files
• Export processed images and metadata in various formats

Important: All metadata generation is performed in English only. Other languages are not currently supported.

3. User Accounts

To use certain features of our Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Updating your information to keep it current

You must be at least 18 years old to create an account. We reserve the right to terminate accounts that violate these Terms.

4. Credits and Payment

Our Service operates on a credit-based system:

• New users receive 50 free credits upon registration
• One (1) credit is consumed per image for metadata generation
• Category generation is provided free of charge
• Credits can be purchased through our pricing plans
• Unused credits expire according to your plan terms

All payments are processed securely through Stripe. By purchasing credits, you agree to Stripe's terms of service.

Refund Policy: No refunds are provided for credit purchases or subscriptions. We provide 50 free credits upon registration to allow you to thoroughly test the Service before making any purchase. These free credits are sufficient to evaluate the quality and suitability of our metadata generation for your needs. By purchasing credits or subscribing to any plan, you acknowledge and agree to this no-refund policy.

5. User Content

You retain all rights to the images you upload ("User Content"). By uploading content, you grant us a limited, non-exclusive license to:

• Process your images for metadata generation
• Create thumbnails for display within the Service
• Store your content for the duration specified in your account
• Generate AI-based metadata using third-party services

You represent and warrant that you own or have the necessary rights to all User Content you upload.

6. Prohibited Uses

You agree not to use the Service to:

• Upload illegal, harmful, or offensive content
• Infringe on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems or bots without permission
• Resell or redistribute the Service without authorization
• Upload malware or harmful code

7. AI-Generated Content and Language Support

The metadata generated by our AI service is provided as a tool to assist your workflow. You acknowledge that:

• AI-generated content may contain errors or inaccuracies
• You are responsible for reviewing and editing all generated metadata
• We do not guarantee acceptance by stock photo agencies
• The quality of results depends on input image quality
• The Service operates in English only - all metadata (titles, descriptions, and keywords) is generated exclusively in English
• No other languages are currently supported for metadata generation

Language Limitation: MetaPhotoAI currently generates metadata exclusively in English. The AI models are trained on English language data, and all titles, descriptions, and keywords will be produced in English only. Support for additional languages may be considered in future updates.

8. Data Retention

We retain your data according to the following policies:

• Uploaded images and metadata are stored for 30 days
• After 30 days, folders and their contents are automatically deleted
• Account information is retained while your account is active
• You may delete your data at any time through the Service

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by MetaPhotoAI and is protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used without our prior written permission.

10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL METAPHOTOAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless MetaPhotoAI from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
